Abstract
The main aim of this essay is to critically examine Shiffrin’s “Rights Transfer Theory” of promissory obligations (for short, the RTT). According to the RTT, the promisor has a right to perform or not to perform the promised action, and through the communicative action of expressing his or her intention to perform it, the promisor transfers the right in question to the promisee. This explains why the promisor is bound to perform: he or she has no right to decider whether to do otherwise. The RTT loses its explanatory power, however, when the promisor is already (morally) obligated to perform. For he or she has no right to decide to perform or not to perform in the first place. This is the problem of redundant promises. Shiffrin attempts to solve this problem in the following way: in a certain kind of special relationships it is important for the promisor to perform the promised act on the basis of more personal reasons (different from impersonal reasons to perform moral duties) and the RTT can explain this phenomena. I raise two objections to this proposal. First, Shiffrin’s attempt in question gives us complex interpretative questions, and answers to them do not shed a favorable light on the RTT. Second, the idea of the personal character of the reasons for performing the promised action (at least in some cases) can be well accommodated without the basic insight of the RTT. I conclude that Shiffrin overrates the role of the RTT when redundant promises are involved.
