선박안전법상 임시승선자 법적지위 명확화를 위한 연구

해양에서 선박의 안전을 위해 선박에 승선하는 인원에 대한 관리는 매우 중요하며, 현재 선박안전법에 따라 그 법적인 지위가 규정되어 있다. 그러나 선원과 여객을 제외한 임시승선자에 대한 관련 규정이 모호하여, 선박의 안전이 우려되고 있는 실정이다. 화물선과 여객선 등 선박에 일시적으로 승선하게 자인 임시승선자는 관련 규정에 따라 선박에 승선할 수는 있으나 적정한 인원이나, 그 속성에 대한 분류는 논란의 소지가 있으며, 선박의 안전이나 운항목적에 부합하는 지 검토해볼 필요가 있다. 따라서, 이 논문에서는 임시승선자에 대한 국내 규정에 대하여 상세히 검토하였고, 국제협약과 외국에서의 관련 규정들을 비교 분석하여, 우리나라 선박안전법 상 임시승선자에 대한 법적 지위에 대하여 고찰해보았고, 선박의 안전을 확보하기 위한 개선점을 연구하였다.
Abstract
For the safety of ships in the ocean, the management of personals who embark on ships is very important, and its legal status is currently defined in accordance with the Ship Safety Act. However, the relevant provisions for temporary passengers, excluding crews and passengers, are ambiguous so that concerns have raised about the safety of ships. Temporary passengers should follow to the relevant regulations in the Ship safety act, but the classification of the proper number of persons, or its properties in the Law is still controversial, and it is necessary to examine whether it meets the safety of the ship or the purpose of ships’ operation. Therefore, in this paper, the relevant regulations for temporary passengers were reviewed in detail, and the international conventions and related regulations in foreign countries were compared and analyzed to examine the legal status of temporary passengers under the Korean Ship Safety Act.
