2004년 10월 29일자로 채택된 유럽헌법조약은 입법행위의 단순화를 시도하고 있다. 즉, 규칙, 지침, 결정, 권고 및 견해를 포함한 현행 15개 정도의 행위를 유럽법, 유럽골격법, 유럽규칙, 유럽결정, 권고 및 견해의 여섯 가지로 유형화하였다. 또한 유럽헌법은 행위를 제정 방식에 따라 입법행위와 비입법행위로 나누고 있다. 유럽법과 유럽골격법은 전자에, 그리고 유럽결정과 유럽규칙은 후자에 포함된다. 양자 모두 법적 구속력을 가진다는 점에서는 동일하나 전자는 현행 공동결정절차에 해당하는 유럽헌법 제Ⅲ-396조의 일반입법절차에 의거하여 제정되며, 반면 후자는 유럽이사회 또는 각료이사회 등 일부 기관에 의해 제정된다는 점에서 대별된다.
Abstract
The Treaty establishing a Constitution the Future of Europe; ‘the European Constitution’) adopted on October 29, 2004 is trying to simplify the legal acts; the actual legal instruments contain 15 acts under the EC and EU Treaty, but the European Constitution classifies them by six types as European law, European framework, European regulation, European decision, Recommendation and Opinion. According to their adoption method, the acts are divided by legislative acts and non-legislative acts. The former comprises european law and framework, and the latter concerns european regulation and decision. The both of them have the legal binding, but it is different that the former is adopted by the ordinary legislative procedure based on the article Ⅲ-396, ant the latter is done by some institutions as the European Council and the Council of Ministers.
