초록

2019년 9월 10일 국제상업회의소(ICC)에서는 인코텀즈(Incoterms) 제8차 개정분 “인코텀즈 2020 (Incoterms 2020)”을 공표하였다. 인코텀즈 2020은 2020년 1월 1일부터 시행된다. 인코텀즈 2020의 주요 개정을 보면 다음과 같다. 도입(Introduction to Incoterms 2020)의 내용이 확대되었는데, 특히 인코텀즈의 적용사항과 미적용사항을 제시함으로써 인코텀즈의 적용범위를 명확히 하였다. 그리고 인코텀즈 2010에서의 “사용지침(Guidance Note)”을 개선하여 “설명문(Explanatory Note)”으로 대체하였고, 터미널인도(DAT)를 도착지양하인도(DPU)로 변경하였으며, 각 규칙 내의 10개 조항(A1∼A10, B1∼B10)의 순서와 조문 표제를 일부 변경하였다. 또한, CIP와 CIF의 적하보험 부보수준을 차별화하여 CIP에서는 ICC(A)조건으로 부보수준을 강화하였고, CIF에서는 ICC(C)조건을 유지하였고, FCA, DAP, DPU 및 DDP에서 매도인 또는 매수인 자신의 운송수단에 의한 운송을 허용하였고, 운송의무 및 비용 조항에 보안관련요건 포함시켰으며, FCA에서 당사자의 합의로 ‘본선적재표시가 있는 선하증권’을 요구할 수 있도록 하였다.

Abstract

On 10 September 2019, the International Chamber of Commerce (ICC) launched the IncotermsⓇ 2020, the 8th revision. The Incoterms 2020 shall enter into force on 1 January 2020. The Incoterms® rules are the world’s essential terms of trade for the sale of goods. As to the major changes in the IncotermsⓇ 2020, the IncotermsⓇ 2020 provides “Introduction to IncotermsⓇ 2020” which specifies what the IncotermsⓇ 2020 Rules do and what the IncotermsⓇ 2020 Rules do not do. “Introduction to IncotermsⓇ 2020” also sets out the important fundamentals of the IncotermsⓇ 2020 Rules. Other changes are: change for DAT (Delivered at Place) to DPU (Delivered at Place Unloaded), different levels of insurance cover in CIF (requires for ICC(C)) and CIP (requires for ICC(A)), bills of lading with an on-board notation and the FCA rule, changes for Guidance Note ro Explanatory Note for Users in the respective Rule, arranging for carriage with seller’s or buyer’s own means of transport in FCA, DAP, DPU and DDP, inclusion of security-related requirements within carriage obligations and costs, etc.
