전자감독형 가택구금의 활용 방안에 관한 연구

가택구금은 구금대상자를 교정시설이 아닌 집이나 그 외 기타 지정장소에 구금하는 사회 내 구금의 한 형태로, 교정시설 과밀수용을 완화하고 교정비용을 절감하는 기능을 수행한다. 그리고 가택구금은 시설 내 구금으로 인한 사회와의 단절을 방지하고 악풍감염을 방지하며, 무죄추정을 받는 미결수용자의 방어권을 보장한다. 이와 같은 효과에 기인하여 미국은 가택구금을 재판 확정 전 구금부터 형 집행 완료 후 보호관찰까지 형사사법절차 전(全)단계에 걸쳐 활용하고 있다. 가택구금의 형태와 준수사항은 개별적으로 정하여지며, 감독은 원칙적으로 전자감독 방식으로 이루어진다. 그리고 2018년 제정된 첫 번째 단계법(First Step Act)은 가택구금 대상자를 노인・말기환자・저위험범죄자로 확대하고 허용기간도 남은 집행기간 전체로 연장할 수 있도록 하였다. 본 문헌은 미국의 가택구금제도를 바탕으로 형사사법절차에 따른 대상자의 법적 지위, 구금과 감독 방식을 검토하고 미결구금의 대안으로서 가택구금, 형 집행의 방식으로서 가택구금, 형 집행 종료 후 보안처분으로서 가택구금, 중간제재로서 가택구금, 고령화 시대에 따른 가택구금 유형으로 분류하여 운영방안을 모색하였다.
Abstract
Home detention is a form of community correction in which people are detained at home or other designated locations rather than correctional facilities. It serves the function of alleviating overcrowding in correctional facilities and reducing correctional costs. In addition, home detention prevents disconnection from society due to detention within the facility, prevents pretrial detainees and short-term prisoners from being infected by negative influences, and guarantees the right to defense of pretrial detainees who are presumed innocent. Due to this effect, the United States utilizes the home detention system throughout the entire stages of the criminal justice procedures, from pre-trial detention to probation after completion of sentence. The form and compliance of home detention are determined individually, and supervision is, in principle, carried out through electronic supervision. And the First Step Act, enacted in 2018, expands the scope of home detention to include the elderly, terminally ill, and low-risk criminals with the purpose of resolving overcrowding in federal prisons, and extends the allowable period to the rest of the execution period. Based on the U.S. home detention system, this article suggests pre-trial home detention as an alternative to pretrial detention, home detention as a method of execution sentences, and home confinement as a security measure. Furthermore, the operation of the home detention as an intermediate correction according to the aging era was suggested.
