영국의 개인정보보호법- 연혁 및 1998년 정보보호법의 적용범위를 중심으로 -

Abstract

The Republic of Korea Assembly is recently discussing the enactment of new basic law about personal information protection as well as revision to "Law of Information Telecommunication Network Use Promotion and Data Protection etc." which provides several articles relating to personal information protection. Under this circumstances, comparative analysis between foreign countries' and Korea would be very helpful and useful for legislation process. From this perspective, this paper deals with Data Protection Act 1998 in the U.K., especially focusing on the definition and extent of personal information, and exceptions to the provisions. Data Protection Act 1998 covers both in public and private sectors. The Act provides general principles on data protection, Information Commissioner, Information Tribunal, trans-border flows of personal information. Especially, the Act covers manual filing systems as well as automatically processed data. And it provides wide-range exceptions to the provisions. These distinctions will be able to be reflected in our legislation process.
