이 논문에서는 베트남의 토지관련 법과 제도를 소개하고, 베트남의 산업화․도시화에 따른 토지이용과 개발사업에 있어서 필요한 주요 개념들에 대해서 살펴보았다. 먼저, 베트남 내의 토지는 국가 발전의 중요한 특별한 자원이며 법에 따라 관리되며, 그에 따라 토지법이 제정되었다. 토지법은 베트남의 경제체제의 변화를 확인할 수 있는 중요한 계기가 된다. 둘째, 베트남은 토지에 대한 특별취급을 위해 소유권과 사용권을 분리하고있다. 토지의 이용과 개발에 대해서는 토지사용권이 핵심적인 역할을 하게 되며, 토지사용권의 부여방식, 내용, 기간 및 양도 방법 등에 대한 이해가 필요하다. 셋째, 국가는 그 소유권에 기반하여 토지이용계획의 수립, 토지의 등록, 토지의 사용료 징수, 토지가격이나 사용 기한을 결정한다. 베트남에서 토지의 개발사업을 추진하기 위해서는 토지의 회수와 보상 및 사용이 필요한데, 이에 대한 충분한 법적 검토가 이루어져야 순조로운개발사업이 가능하다.
Abstract
This paper introduces Vietnam's land-related law and systems. The main concepts required for land use and development projects in accordance with the industrialization and urbanization of Vietnam were examined. First of all, land in Vietnam is an important special resource for national development and is managed in accordance with the law. Land law was enacted accordingly. Land law is an important opportunity to confirm the change of Vietnam's economic system. Second, for special handling of land, ownership and use rights of land are separated. Land use rights play a key role in the use and development of land. It is necessary to understand the method, content, period and transfer method of land use rights. Third, the State decides on the basis of its ownership the establishment of land-use plans, the registration of land use rights, the collection of land royalties, the land price or the expiration date. In order to promote land development projects in Vietnam, land recovery, compensation and use are required. And sufficient legal review for land law is required for a successful development project
