범죄대본을 통한 청소년 성매매 알선 범죄분석: 범죄의 진행과정과 예방 전략을 중심으로

초록

그동안의 청소년 성매매 알선 범죄에 대한 연구는 개인과 환경특성 등에집중하여 종합적이지 못하였고, 대응방안이 청소년이 성매매로 유입되기 이전시점에 한정되어 있다는 한계가 있었다. 본 연구에서는 46건의 법원판결문에대한 범죄대본 분석을 진행하여 청소년 성매매가 발생하는 범죄의 시작부터종료까지 일련의 진행과정을 분석하였다. 선행연구의 틀을 근거로 아동·청소년 성매매 알선범죄의 과정을 접근, 수단적 개입, 준비장소 관련 개입의 지속, 알선 방법 관련 개입의 지속, 범죄의 실현, 범죄의 완수, 결과, 은폐 등 총 8 단계로 나누어 범죄대본 분석을 진행한 것이다. 기술통계 결과, 접근방법은아는 사이인 경우(21.3%)가 가장 많았으며 수단적 개입으로는 제안의 전략(49.2%)이 가장 많이 사용되었다. 준비장소는 가해자의 주거지(19.6%)가 가장많았으며 알선 방법은 앱(87.3%)을 이용한 경우가 압도적이었다. 범죄의 실현장소는 모텔(44%)이 가장 많았으며 수익 분배로는 일부씩 나누어 갖는 경우(58.7%)가 가장 많았고 알선 횟수는 사건 당 평균 16.5회 발생하였다. 범죄의결과 및 은폐전략은 파악할 수 있는 부분이 적었으나 피해자의 거부의사 표현과 가해자의 폭행, 협박 등의 대응이 있음을 확인하였으며 은폐전략으로는주로 피해자로 하여금 허위진술을 요구하였다. 분석결과를 토대로 범죄삼각형에 착안하여 장소 관리자의 측면에서는 앱의 미성년자 접근을 강화하는 방안, 청소년 보호자의 차원에서는 부모-자녀 간 소통기회 마련 등 관계의 개선 및유지를 위한 방안, 그리고 가해자 관리인 측면에서는 건전한 일자리 기회의증대를 제안하는 등 각 단계별 예방대책을 제시하였다.

Abstract

Research on adolescent prostitution arrangement has not been comprehensive by narrowly focusing on individual characteristics or social environments. It has also given too much attention to the time period prior to actual prostitution. To fill the void in previous studies, this research conducted crime script analysis of 46 adolescent prostitution exploitation related court ruling cases in South Korea. Based on the template of previous research, we conducted crime script analysis of 8 stages of adolescent prostitution arrangement: entry to setting, instrumental initiation, place preparation continuation, arrangement method continuation, actualization, completion, outcome, avoiding disclosure strategies. Descriptive statistics are as follows: the cases that already acquainted each other are 21.3%, suggestion strategies are used by 49.2%, and 19.6% of preparation place is offender's house. Application is used most by arrangement method, actualization place is motel by 44%, the profits were divided in part, and the average number of arrangements was 16.5%. In some cases, the victims expressed rejection and offenders responded with threat or assault. According to the results, we proposed crime triangle based prevention policies. These policies include restricting access to related application, improving parent-children relationship, and enhancing opportunities for reasonable jobs.
