Abstract

The Korean antitrust law can be applied extraterritorially to anticompetitive practices entered into outside but implemented or producing effects within the Korean market. The Antitrust law applies to extraterritorial activities that were intended, and actually do, cause anticompetitive effects in Korea. The Korean antitrust law section 3(Application to Overseas Act) stipulates that in cases where any act that performs even abroad affects the domestic market, this Act shall apply to such act. According to this law, the Korea Fair Trade Commission(the KFTC) should prove the effects of the agreement on the Korean market. Recently the extraterritorial application issues of the Korean antitrust law and consumer protection law tend to be increasing. However, the expansion of the domestic law based on effect tests of extraterritorial application principle needs to be balanced with the comity, the reality of international relations and the scope and the limits of extraterritorial application. That is why the KFTC and the courts should strike a balance in deciding the extraterritorial application. The extraterritorial application of the consumer protection laws is more cautious than the application of antitrust laws. Consumer protection laws are often unique to Korea, and extraterritorial application of consumer protection laws can cause various problems. Even if it is possible to apply consumer protection laws extraterritorially, it is necessary to limit the range of the extraterritorial application of consumer protection laws to cases where ‘effects’ is recognized. It is unreasonable to apply extraterritorially to protect individual consumers, and it is excessive to apply consumer protection laws extraterritorially for a single private transaction, so even if extraterritorial application of consumer protection laws is enforced, extraterritorial application should be considered in cases where consumer protection related to the trading order beyond individual consumer protection is at issue. In the KFTC's enforcement of terms and conditions regulation laws against overseas operators, it has centered its enforcement of Act on the regulation of terms and conditions on consumers protected under private international law. Of course, there are limitations to the protection of domestic business operators when applying the Act on the regulation of terms and conditions to foreign platform companies through international private law, but since Act on the regulation of terms and conditions is an unusual legal form in comparison, it is necessary to interpret it restrictively, and it can be evaluated that it is appropriate to limit the scope of extraterritorial application, such as excluding the part about business operators.
