Abstract

Commercialization of autonomous vehicles that incorporate advanced science and technology gives safety and convenience to humans, but if a traffic accident occurs, the civil liability for victims will rise. It is necessary to examine some issues of product liability among them. Autonomous vehicles equipped with software are considered to be the manufacture, and both the automobile manufacturer, the component manufacturer and the raw material manufacturer are responsible. It is an important challenge for the victim entity to demonstrate defects in manufacturing, defects in design, defects in design, marking defects, and product liability, which are key elements of product liability. Even if a manufacturer is liable for product liability, if a manufacturer asserts a defense of development risk as a reason for indemnification, the liability will vary depending on the level of science and technology at the time of supply, which is referred to as development risk. Through review of these issues, it is expected that the amendment of the Product Liability Law will become a reference and a very beneficial amendment will be made
