난민 정의상 젠더나 성적 지향이 박해의 이유에 명시되지 않아 이에 대한 적극적인 법 해석 의 필요성이 제기된다. 무엇보다도 젠더와 성적 지향과 같은 복합적인 범주는 서로 교차하면서 다른 현실을 만들어내고 이로 인해 난민신청자는 가중된 차별과 추가 위험에 노출되어 박해의 대상이 될 수 있다. 본 논문에서는 유엔난민기구가 제시한 젠더, 성적지향, 젠더 정체성의 개념 을 알아보고 유엔난민기구와 캐나다 이민・난민위원회 등 해외 난민심사 가이드라인을 통해 우 간다 성소수자이며 여성인 난민신청자에 대한 난민불인정결정(취소)을 다룬 판례를 분석한다. 사안 1은 법원에 제시된 증거와 진술만으로 원고가 동성애자라는 사실을 믿기 어렵다며 사실 확정과 진술의 신빙성이 문제가 되었다. 사안 2의 경우에는 동성애 사실에 대한 진술상의 불일 치, 성폭행을 밝힌 시점, 정신과적 증상과 신빙성의 관계, 반동성애법의 존재, 대안적 국내피신 등이 주요한 쟁점이 되었고 현재 대법원에서 소송이 계속 중에 있다. 마지막으로 논문은 여성 과 성소수자에 대한 고정관념이나 편견 방지 등을 위해 국내외적으로 소통되는 난민심사 및 재판의 원칙과 기준으로 구성된 가이드라인의 필요성을 강조한다.
Abstract
With the legal definition of refugee not including gender or sexual orientation as listed reasons of persecution, it has become significant in the interpretation of legal texts to expand the narrow definition. In recent years, two legal cases, involving female refugee claimants from Uganda who applied for refugee status on the basis of sexual orientation, have demonstrated the need for changes in interpretation rules and practices from an intersectional approach. Through these two cases, this article details the importance of understanding and considering the intersection of gender and sexual orientation when determining whether a refugee claimant has established a well-founded fear of persecution and that he or she could face differential or additional risk upon return. It introduces the concepts of gender, sexual orientation and gender identity, and applies the principles and rules of existing guidelines, as issued by the UNHCR and the Canadian Immigration and Refugee Board, to the two cases. Finally, this article emphasizes that in South Korea it is necessary to have guidelines that open to the public, and which provide guiding rules and principles for adjudicating cases, particularly for vulnerable persons. Such guidelines are argued to likely help to examine and determine cases in a gender-sensitive way, and to prevent stereotyping and prejudicing in the refugee determination processes as well as in other legal procedures.
