Abstract

This study analyzes the working conditions of nurses subject to Article 59 of the Labor Standards Act (Special Provisions for Working Hours and Breaks) and the need for institutional improvements. Article 10 of the Constitution of the Republic of Korea guarantees the dignity, value, and right to pursue happiness for all citizens, which implies that all workers are entitled to the right to rest. According to the Labor Standards Act, employers may extend working hours and change break times with a written agreement with the workers’ representative, allowing for overtime exceeding 12 hours per week under special provisions. However, after such overtime, employers must guarantee at least 11 consecutive hours of rest before the next workday begins. These special provisions apply to certain sectors, including nursing. Nurses are exposed to poor working conditions, such as long working hours, night shifts, and unpaid labor, and their actual working hours often exceed the official limit of 8 hours per day (40 hours per week). Recent surveys indicate that the average daily working time for nurses is 10.6 hours, with irregular schedules due to three-shift rotations. Furthermore, as the nursing sector is classified as an exception to the 52-hour workweek, overtime is frequent. These conditions are identified as major causes of health rights violations and high turnover among nurses. While the special provisions for working and break hours are permitted in certain sectors for reasons of public convenience and safety, they may substantially infringe upon workers’ health and safety. Although the introduction of such special provisions is legally justified for the public good, it cannot be used to legitimize long working hours or prioritize business profits over workers’ health and safety. Therefore, it is more appropriate to introduce alternatives such as flexible working hours or shift work rather than maintaining the special provisions that allow for extended working hours. Additionally, the application of special provisions should be differentiated, taking into account the size of the workplace and the nature of the work, and limited to certain workers as appropriate. In the long term, it is necessary to consider excluding the nursing profession from the list of special sectors under Article 59 of the Labor Standards Act. Policy support, such as the institutionalization of the “Pilot Project for Improving Nurse Shift Systems,” should be provided to gradually improve workforce management in medical institutions.
