Abstract
Although there has been extensive discourse and analysis regarding sexual violence in armed conflict from a gender perspective within the framework of international humanitarian law, there has been comparatively limited examination of its definition and the corresponding responses in the context of transitional justice. The Investigation Report on the Truth of the May 18 Democratic Movement was released concerning the sexual violence perpetrated by martial law forces during the May 18 Democratic Movement, a notable instance of sexual violence in armed conflict. The Report inadequately addressed the constraints of the transitional justice process, neglecting the viewpoints of criminal justice, restorative justice, and compensating justice, and failing to clarify the objective of truth-seeking. This paper analyzes the concept of transitional justice and the discourse surrounding violence against women in armed conflicts, while investigating the trajectory of the concept, inquiry, and truth-seeking related to sexual violence in such contexts as integral components of the transitional justice process aimed at addressing sexual violence and reinstating victims' rights. This paper examines international cases of truth commissions as instances of transitional justice related to sexual and gender-based violence in armed conflicts, and delineates the truth-seeking process and victim recovery efforts as responses to such violence from a gender perspective.
