스페인 경제헌법에 대한 고찰

스페인 경제헌법에서 본질이 되는 조문의 내용이 무엇인지와 관련해서 여러 학자들마다 견해가 다 르지만, 경제헌법은 헌법의 일부분을 구성하는 내용으로 경제와 관련된 규범들의 중요성을 더 높이기 위한 해석상의 표현이라고 이해될 수 있다 . 1978년 현행 헌법에서 경제와 재정에 관한 장을 별도로 둔 것은 스페인 입헌주의에 있어 새로운 변화이다. 스페인 경제헌법의 대강을 파악하기 위해서는 헌법 전체를 유기적으로 살펴볼 필요가 있는 데, 경제헌법의 기저에는 헌법 제1조의 사회국가의 원리와 밀접한 관련이 있음을 알 수 있다. 사회국 가의 원리는 정치적, 사회적 질서에 관한 근원적인 해석의 기준이 되고, 오늘날 경제위기의 상황에서 국가가 경제에 개입할 수 있는 목표를 제시해준다. 또한, 스페인의 경우, 여러 지방의 다양성과 정치세 력들의 입장을 반영하려다보니, 현재의 비대칭적인 형태의 지방분권화에 이르게 되었는데, 이에 따라 스페인 전역에서 경제활동을 하면서 기본조건이 동일할 것이 요청되는 단일시장의 원칙이 특히 강조 되어 왔다. 스페인 경제헌법에 대한 이해는 공통적으로 헌법의 경제적 중립성, 즉 헌법에서 국가개입의 위헌여 부의 판단기준이 되는 특정 경제모델을 정하고 있지 않다는 데에서 출발한다. 헌법재판소도 명시적으 로 밝히진 않았지만 이러한 취지를 따르고 있다. 그럼에도 상당수의 학자들은 스페인 헌법상 경제질서 를 사회적 시장경제 내지 혼합경제 질서로 평가하고 있다. 일반경제에서 스페인 경제헌법이 구체화되는 특징들을 보면, 국가의 경제개입을 정당화시키는 근거 로 헌법 제128조 제2항 제1문의 공공의 주도권이 기본전제가 되고, 이를 통해 국가개입의 보충성의 원칙의 의미가 단절되었다고 설명되고 있다. 헌법 제128조 제2항 제2문의 기업에 대한 개입은 원칙적 으로 기업이 소유권을 보유하되 공권력이 개입하는 것을 의미하며, 이러한 경우들은 법률유보에 따라 야 한다. 한편, 국가가 헌법 제38조의 기업의 자유를 보장하는 역할도 하는데, 그러한 예로 협동조합 의 조성을 장려하는 것을 들 수 있다.
Abstract
Although the views of scholars differ in what the essence of the Spanish economic constitution provision is, economic constitution constitutes a part of the Constitution and it can be understood as an interpretive expression to enhance the significance of norms related to the economy. It is a new change in Spanish constitutionalism that the 1978 Constitution contains a separate chapter on economy and finance. In order to grasp the Spanish economic constitution, it is necessary to examine the constitution as a whole. It should be noted that the underlying basis of the economic constitution is closely related to the principle of the social state as in Article 1 of the Constitution. The principle of the social state is the criterion for fundamental interpretation with regard to the political and social order and presents an objective for the state to intervene in the economy in today's economic crisis. Also in the case of Spain, as a result of efforts to reflect the diversity of the various areas and the positions of the political forces, it has led to the current asymmetric decentralization. There has thus been a particular emphasis on the principle of a single market in which economic activity throughout Spain is required to have the same basic conditions. The understanding of the Spanish economic constitution is based on the economic neutrality of the Constitution, that is the Constitution does not provide a specific economic model which is the basis for judging the constitutionality of state intervention. The Constitutional Court has not explicitly stated in this regard, but it follows such premise. Nonetheless, many scholars consider the Spanish constitutional economic order as a social market economy or a mixed economic order. The characteristics of how the Spanish economic constitution in the general economy are materialized, the public initiative in the first sentence of Article 128(2) of the Constitution is a basic premise as a justification for the state's economic intervention and as a result, the meaning of the principle of subsidiarity of state intervention has broken off. Intervention to the company in the second sentence of Article 128(2) basically means the company holds ownership while the governmental authority's intervention and such cases must be in accordance with the principle of statutory reservation. On the other hand, the state also plays a role in ensuring the freedom of enterprises under Article 38 of the Constitution, for example, promoting the creation of cooperatives.
