Abstract
This study focused compulsory license of production of drugs. Many patent law systems provide for the granting of compulsory licenses including Korea. TRIPs(The Agreement on Trade-Related Aspects of Intellectual Property Rights) also sets out specific provisions in the case of a national emergency or other circumstances of extreme urgency or in cases of public non-commercial use. The Ministry of Health and Welfare was reported to have said that it would grant a compulsory license on Tamiflu in case the supply of these drugs run short of demand. Lawmakers proposed legislation on the mitigation the requirements for a compulsory license for the production of drugs. However, I suggest these legislation is unnecessary and legal analysis existing law would solve this situation. The purpose, proper means, balance of right would be helpful in determining the "public interest" in case of setting the compulsory licence. This paper aims to suggest a standard to deal with interest of patent owner and pubic health.
