Abstract
In Spain, gender violence seems to be studied, centering on domestic violence. Currently, the problem of stalking in Spain appears to be related in terms of domestic and gender violence. Before the revision of the criminal law, Spain had already implemented legislation related to gender violence. What is unique is that Spain has mainly focused on gender violence to protect women from domestic violence caused by spouses or separated spouses, which led to legislation. In Europe, the UK legislated stalking crime for the first time, starting in 1997. After that, Spain also incorporated stalking as a criminal offense due to the criminal law amendment conducted by LO 1/2015 dated March 30, 2015 (Article 172-3 of the Criminal Code). In the current Spanish Criminal Code, stalking is one of the ‘crimes that infringe on freedom of action’ as the epitome of predatory harassment. The background of this legislation was the 2011 European Council Convention on the Prevention and Elimination of Violence against Women and Domestic Violence. Article 34 of the Istanbul Convention stipulates legislation or other measures to criminalize intentional and repeated threatening actions that cause victims to fear for their safety. The criminalization of stalking through the revision of criminal law in Spain also reflects this request. It made Spain a European country, including stalking in the Criminal Code. This paper briefly describes the status and perception of stalking crimes, legislation, protection of victims in Spain, and suggestions for Korean legislation.
