死因贈與에 관한 考察

Abstract

The Korean Civil Code provides about Gift and Gifts mortic causa as followings. Article 554 says about 'Meaning of Contract of Gift' that "A contract of gift shall become effective when one of the parties declares his intention to transfer property of his own gratuitously to the other party and the other party agrees to accept it". And Article 562 provides about 'Gifts mortis causa' that "The provisions relating to testamentary gifts shall apply mutatis mutandis to a contract of gift which is to become effective upon the death of the donor". There are several legal problems about Gifts mortis causa.
