연대성의 국제법상 법적지위에 관한 고찰- 국제법상 법의 일반원칙으로서 연대성 -

지구상의 거의 모든 국가들은 다양한 문제를 해결하기 위해 국제기구의 설립 및 국제협정의 채택 등과 같은 다양한 조치를 취하여 왔다. 이와 같은 공동의 목표달성(즉, 당면한 문제의 해결)을 위해서 (동등한) 주체들(즉, 국가들)이 호혜(reciprocal)의 관점이 아닌 서로 (상이한 의무를 부담하며) 협력하는 것(즉, 상호간에 돕는 것)을 연대성 (solidarity)이라고 한다. 이러한 연대성은 여러 분야에 걸친 수많은 국제법 규정, 국가들의 관행 및 국제문서에서 발견되어 왔으며 국가들간의 문제들을 해결하는데 있어서 중요한 역할을 하여 왔다. 이와 같은 연대성의 중요성에도 불구하고, 국제법상 연대성은 무엇을 의미하는지 및 어떠한 법적 지위를 점하고 있는지 등에 관한 심도있는 고찰이 현재 국내 학계에서 거의 행해지지 않고 있다는 점을 감안하여 본 논문에서는, 연대성이라는 개념이 국제법상 어떠한 법적 지위를 가질 수 있는지에 중점을 맞추어 논의하였다. 즉, 국제법상 1차 규칙에 해당하는 국제환경법, 국제해양법, 국제경제법 등의 관련 원칙들 뿐만 아니라 국제법상 2차 규칙에 해당하는 국가책임법에서의 관련 규정들을 분석하고 특히, 지역적 차원에서의 국가관행 등을 살펴봄으로써 연대성이라는 개념이 얼마나 널리 국제사회에서 이용되어 왔는지에 대해 제시함으로써 법의 일반원칙으로서의 지위를 획득할 수 있음을 고찰하였다.
Abstract
Almost all the countries around the world have taken diverse measures to address a number of problems facing them, such as climate change, terrorism and protectionism. As discussed in this article, it is defined as (international) solidarity that equal entities (i.e. sovereign states) undertake (a different degree of) mutual obligations to address such problems (i.e. attain common goals) in a non-reciprocal manner. Although the concept has played important roles in the international arena and thus, a number of scholars and commentators have discussed its significance in international law, as few articles have been found on the status and roles of solidarity in international law within Korean international law society, this article would like to explore what solidarity means in international law and what status it obtains based on the comprehensive analysis of a wide array of international conventions and principles and relevant institutions and treaties at a regional level. That is, not only primary international rules such as international environmental law and law of the sea but secondary rules such as the law of state responsibility were analyzed in this article, based on which how widely the concept of solidarity has been used by countries in the world was discussed. On that basis, this article argues that the concept has obtained the status of general principle of law provided in article 38(1) of the Statute of the ICJ.
