성희롱 판단 기준과 사용자의 대리책임 : 미국 EEOC 지침을 중심으로

이 글은 미국 EEOC가 제공하고 있는 “현하(現下) 성희롱 이슈에 관한 정책지침(EEOC Policy Guidance on Current Issues of Sexual Harassment)”(이하, ‘EEOC 성희롱지침’)과 “관리자에 의한 불법적인 성희롱을 이유로 하는 사용자의 대리책임에 관한 지침(EEOC Enforcement Guidance: Vicarious Employer Liability for Unlawful Harassment by Supervisors)”(이하, ‘EEOC 관리자의 성희롱에 대한 사용자 대리책임에 관한 지침’)의 내용을 정리해 살펴보는 것을 주된 목적으로 하였다. 전자는 주로 성희롱의 판단에 관한 내용을 담고 있는 한편, 후자는 적대적 환경형 성희롱에 대한 사용자 책임의 기준, 특히 성희롱 가해자가 창출한 적대적 근로환경에 대하여 사용자가 대리책임이 있는지 여부를 중심으로 다루고 있다. 이 지침들의 내용은 현재 우리나라의 성희롱 법제 및 해석, 판례를 통해 주요한 이슈가 되고 있는 문제들 즉 첫째 성희롱 구제는 누가 담당할 것인가, 둘째 성희롱을 판단하기 위한 기준을 어떻게 정립할 것인가, 셋째 사용자의 책임 범위는 어디까지인가 하는 문제들에 대하여 주요한 시사점을 줄 수 있다. 이들 문제는 향후의 연구과제이다.
Abstract
The main object of this paper is to sum up and study EEOC Policy Guidance on Current Issues of Sexual Harassment and EEOC Enforcement Guidance: Vicarious Employer Liability for Unlawful Harassment by Supervisors provided by US EEOC. The former is mainly on judgement of sexual harassment whereas the latter deals with the criteria of employers’ liability for hostile environment type sexual harassment, especially whether an employer has vicarious liability for the hostile working environment created by a sexual harasser. These guidances may provide important suggestions for main issues of current legislation, interpretation and precedents of Korea on sexual harassment: who would be in charge of relief of sexual harassment; how to set up the criteria of sexual harassment; and what the scope of employers’ liability is.
