Abstract

The traditional national responsibility for environmental damage under international environmental law is that the affection country has the responsibility of compensation for damage to the affected country in the event that the actions of the state agency or the actions of individuals attributed to the country harm the environment of another country. Parties are generally liable under international law if they violate the duties of an environmental treaty or omission. And because the obligation to prevent environmental damage is recognized under international customary law, national responsibility may arise even if it violates the obligation to prevent environmental damage or reduce damage. On the other hand, there is no objection that the traditional national liability law applies to the Trans-boundary environmental damage under international law. In 1992, Non-Compliance Procedures were developed. In other words, the non-compliance procedure is to prevent the occurrence of non-compliance with the cooperation of the Parties, to ensure compliance, should be able to provide assistance in the event of non-compliance, and also includes mechanisms for dispute resolution, and even enforcement action. The increasing number of non-compliant procedures, diversity and uniqueness, which have been implemented several times in the implementation of international treaties on environmental protection, show the great progress of international environmental legislation. The development of the international protection of the rights to a sound environment is, first, to impose the most comprehensive substantive duty on the state. Second, norms on the international protection of the rights to a sound environment have an impact on companies as well, it imposes indirect obligations and direct obligations on both sides. In short, the trend of national responsibility in environmental damage is not to blame the State for failing to comply with its obligations under environmental treaties, from the expansion of traditional national responsibility to the progress of non-compliance procedures, is to ensure that the country can comply with its obligations through technical or financial support. Furthermore, recognition of the right to a sound environment, together with the mechanism of international environmental protection, shows a desirable development in environmental protection. Considering these trends, it will be a major reference in concluding an effective environmental agreement with neighboring countries in the future.
