南冥先生神道碑 踣碑事件에 관한 소고-사건과 관련된 通文을 중심으로-

眉叟 許穆이 지은 德山碑 즉 南冥先生神道碑는 1585년에 세워졌는데, 1926년에 南冥 曺植의 후손인 德山 曺氏 門中에 의해 훼손되어 없어지고 말았다. 이 사건으로 인해 晉州 鄕校와 德山 曺氏 門中 사이에 법적 소송이 벌어졌다. 진주 향교는, 미수 허목의 글을 없앴다는 이유와 조상의 신도비를 훼손한 것은 명백한 잘못이므로, 비석을 원상복귀하고 도내 유림에게 사죄하라고 주장하였다. 반면에 덕산 조씨 문중은, 미수 허목이 지은 비문의 내용에 자기들의 조상이자 만인이 추앙하는 남명 선생을 비하하는 내용이 들어있기 때문에 더 이상 두고 볼 수가 없었기 때문이라는 주장을 폈다. 하지만 실상 문법적으로 본다면, 비문의 내용을 굳이 악의적으로 보아야 할 이유는 없다. 그럼에도 불구하고 비문의 내용이 악의적인 의도에서 지어진 것이라고 덕산 조씨 문중에서 단정하는 이유는 바로 『記言』에 실린 「答學者」에서 미수가 남명을 폄하하고 있다는 뜻을 드러냈기 때문이라고 보아야 한다. 본고는 남명선생신도비를 둘러싸고 벌어진 사건에 대해 덕산 조씨 문중이 어떤 시각으로 임하고 있는가를 구체적으로 밝히려는 목적으로 작성된 글이다.
Abstract
Duk-san gravestone namely Nam-myoung’s cenotaph[南冥先生神道碑] by Mi-soo, Huh-Mock[眉叟 許穆] was established in 1585, but damaged and destroyed by The Cho’s in Duk-san[德山 曺氏 門中], descendant of Nam-myoung, Cho-sik[南冥 曺植] in 1926. Because of this incident, a lawsuit was filed between The local school annexed to the confucian shrine of Chin-ju[晉州 鄕校] and The Cho’s in Duk-san[德山 曺氏 門中]. The local school annexed to the confucian shrine of Chin-ju[晉州 鄕校] argued that it was obviously wrong to eliminate the work of Mi-soo, Huh-Mock[眉叟 許穆] and harm cenotaph[南冥先生神道碑] of ancestor, so The Cho’s in Duk-san should restore the memorial stone and apologize to The confucian scholars of the district. On the other hand, The Cho’s insisted that they could not sit back and watch the situation anymore, since the contents of epitaph written by Mi-soo, Huh-Mock contained insults of Mi-soo who was their ancestor and also revered by everybody. However, we do not need to consider it malicious, if we examine it grammatically. Nevertheless, The Cho’s in Duk-san concluded that the contents was ill-intentioned, because Mi-soo was disparaging Mi-soo in 「Dap-hak-ja(答學者)」 of 『Ki-un(記言)』. This article is written in order to clarify the viewpoint of The Cho's in Duk-san in this incident over Nam-myoung’s cenotaph.
