스토킹범죄를 처리하는 경찰관들의 어려움: 면담조사를 중심으로

Abstract

A year has passed since the Act on the Punishment of Stalking Crimes was enacted on October 21, 2021. The Act on the Punishment of Stalking Crimes passed the National Assembly for the first time in 22 years, but violent crimes against stalking victims have continued. Many existing studies have investigated legal problems with an emphasis on the Act on the Punishment of Stalking Crimes, but there are various difficulties and limitations in the site for responses to actual incidents. This study was to conduct interview research on police officers to grasp the difficulties of field police officers in response to stalking incidents. The interviewee included on-site police officers, investigative police officers, and stalking support police officers. From the result of the interview, it may be summed up as follows. First, there were opinions pointing out the ambiguous part about the legal 'definition of stalking'. Second, there were a lot opinions that the clause 'Penalty Subject to Consent' should be abolished because there are more adverse events. Third, in the process of emergency measures, there were responses that it was difficult to 'separate' the assailant and victim, and there were many opinions that the police ability to respond to the violators of urgent emergency measures should be enhanced. Fourth, regarding the protection of victims, opinions such as the abolition of Penalty Subject to Consent and the introduction of a victim protection order were suggested, and it was also necessary to secure additional support budget of criminal victim and professional manpower. Fifth, regarding the assailant, there were a lot of opinions that a firm response such as arrest of flagrant offender or strengthening the statutory penalty would be effective in recidivism suppression.
