개정 정치자금법에 대한 비판적 논의와 정책 대안: 정치자금 기부규제를 중심으로

2004년 개정 정치자금법 특히 정치자금기부와 모금방식 규제에 관한 내용을 비판적으로 고찰한다. 민주주의체제에서 정치자금관련 제도들이 지향해야할 목표는 ‘부패통제’와 ‘정치적 평등’이라는 점을 강조하고 과연 새로운 제도가 이러한 목표를 달성할 수 있는 효과적인 수단인가라는 질문과 함께 그에 대한 비판적 논의를 진행한다. 더불어 제도개혁이 때로는 그 목표와는 상반된 의도하지 않은 결과를 초래할 수 있을 수도 있다는 점을 최대한 기존의 이론적ㆍ경험적 연구결과에 근거하여 밝히고자 한다. 이러한 개정정치자금법에 대한 비판에 근거하여 ‘부패통제’와 ‘정치적 평등’라는 목표에 보다 근접할 수 있는, 그리고 민주주의적 정치체제에 보다 부합하는 정치자금 기부규제를 위한 몇 가지 정책 대안을 제시한다.
Abstract
Changes in political finance laws raise fundamental questions about democratic principles. This study maintains that the new political finance regulations seem to be based on the flawed assumptions and likely to produce the undemocratic consequences. Major changes in the Reform Act of 2004 are limiting contribution and banning contributions by corporations and interest groups. Based on various theoretical frameworks and empirical evidences, this paper argues that the new regulations are highly likely to fail to achieve goals of reformers, namely, promoting political equality and controlling corruption. Especially, lowering the contribution limits might hurt non-incumbents and candidates those who have less money, and, ultimately would do great damage to political equality. This paper also presents some policy alternatives to resolve the problems the new regulations would raise; relaxing the restrictions on contribution limits, strengthening the role of political parties as a conduit for the allocation of political money, allowing to organize the voters by corporations and interest groups to raise money for political activity, and, finally, strengthening the enforcement system and public disclosure requirements.
