가정 내에서 발생하는 범죄인 아동학대, 노인학대, 배우자폭력에 효과적으로 대응하기 위해서는 피해자의 욕구에 기반한 보호 및 지원과 함께 가해자의 범죄유발요인을 감소시켜야 한다. 복합적 니즈를 가지고 있는 가해자와 피해자에 충분히 대응하기 위해서는 형사사법기관과 비형사사법기간 간의 연계와 협력이 중요하다. 본 논문에서는 가정내 폭력문제의 감소 및 예방을 위한 다기관협력 강화를 위해 다기관 협력에 실천적 장애가 되는 가장 시급한 문제점들을 정리하고, 다기관협력 강화 방안을 정립해 나가려 하였다. 다기관협력의 이론적 틀로서 미시적, 중시적, 거시적 요인을 함께 고려하는 생태학적 모델을 검토하였으며, 영미를 중심으로 다기관 협력의 모델들을 소개하였다. 다기관 협력의 실체적 운용의 문제점으로 경찰과 피해자지원기간 간에 가정 내 폭력에 대한 판정정도의 차이, 경찰의 업무처리에 대한 불신, 통합사례회의의 중요성이나 가정 내 폭력의 재발원인에 대한 인식의 차이 등이 지적되었다. 특히 복합적 니즈를 가지고 있는 피해자 증가에 따른 기관연계의 한계, 부처간 조율 미비, 통합사례회의의 실효성 부족 등을 지적하였다. 마지막으로, 다기관 협력 체계를 개선하기 위한 서비스의 통합적 관점과 지자체 중심의 사례 관리, 기관 간의 연계 강화 등을 제안하였다.
Abstract
In order to respond family violence(i.e., child abuse, elder abuse, spouse violence) effectively, various measures should be taken to strengthen victims’ needs-based assistance and reduce perpetrator’ criminogenic factors. Working together to respond to victims and perpetrators with multiple needs sufficiently is now accepted as important practice. Yet little is known about how multi-agency working has been operated in Korea. In oder to gain a better understanding of this practice, theoretical framework, that is, ecological model of which considerations range from microsystem to macrosystem was reviewed as well as its practical applications in the US and UK. Among the problems that impede the operation of multi-agency working, agencies were found to be working in isolation from each other with differing perceptions and sensitivity toward the family violence. Agencies saw each other with little understanding of what each other did, and to what extent the multi-agency case conference should be emphasized and how it should implemented. Recommendations to improve multi-agency working were discussed.
