임야지역 지적재조사를 위한 법적 개선에 관한 소고

본 연구의 목적은 임야지역 지적재조사사업을 효율적으로 추진하기 위한 방안으로서 최신의 측량기법(부분적인 간접측량 허용 전제)을 동원하여 임야지역의 지적재조사를 추진할 경우에 따른 프로세스의 개선방안 및 그에 관한 관계법규의 개정(안)을 제시하는 것이다. 이와 같은 연구목적을 효율적으로 달성하기 위해, 연구대상을 임야지역 지적재조사로 특정한 후, 임야지역 지적재조사에 관한 일반론적 내용, 문제점 제시 및 일본의 사례 비교를 통해 현행법 규정에 관한 법해석학적 방법과 기술적(記述的) 분석방법을 통해 그 구체적인 법적 개선방안을 도출하였다. 구체적으로 본 연구는, 현행 지적재조사에 관한 특별법령 및 지적재조사측량규정을 토대로 사업지구의 지정, 지적재조사측량, 경계의 설정, 경계의 결정 및 확정에 관한 규정을 검토하여 임야지역의 특성을 감안한 단계별 개선(안)을 제시하였고, 아울러 임야지역 지적재조사측량에 무인비행장치(UAV)를 활용할 경우에 보완이 필요한 규정까지도 제시하였다.
Abstract
The purpose of this study is to present the improving plans of regulations and institutional process in order to perform cadastral resurvey project in forest area. This study is based on the premise that we can use the unmanned aerial vehicle as the newest technology in the area. To achieve this goal, the object of this study was firstly focused on cadastral resurvey of forest area. Then the existing sundry records were referred. And also, the Japanese cases were compared to our country for understanding an actual state more definitely. As the result, this study suggested that the government should consider some improving plans related to project district designation, means of cadastral resurveying, boundary decision. In addition, this study proposed the provision in case using an unmanned aerial vehicle at the field.
