법률구조제도는 경제적으로 어렵거나 법의 보호를 충분히 받지 못하는 자 또는 장애인 등에게 법률적 지원을 함으로써 기본적 인권을 옹호하고 사회보장체계를 보완하는 중요한 제도이다. 이와 같은 제도는 세계 여러 나라에서 보편적으로 채택하고 있는 사법구조제도이다. 한국법률구조제도는 1956년부터 시작되어 아시아국가에서 선진적이라고 할 수 있다. 이러한 과정에서 서양의 선진적 법률구조제도를 참고하여 수십 년의 노력에 계속적인 보완을 하였다. 중국의 법률구조제도는 한국법률구조제도를 참고하여 보다 나은 체계를 구축하여야 한다.
Abstract
Legal aid system is the law to help the poor, the weak and the disabled. It is an important measure to achieve equality and improve the social security legal system, and a judicial aid system widely adopted by most countries in the world. South Korea is the first country to establish legal aid system in Asian countries, its modern legal aid system originated in 1956. On the basis of absorbing the advanced legal aid system in western welfare countries, the legal aid system in Korea has been constantly improved and developed after decades of development. Many of the Korean legal aid systems are worth learning in China.
