Lucia v.
Abstract
Recently Lucia v. SEC dissolves the long-standing controversy about the constitutional status of administrative law judges (ALJs) that had been raised since the promulgation of the Administrative Procedure Act of 1946. The point of the controversy was whether ALJs have the equivalent constitutional status as the Article III judge under the Appointment Clause of Article II. Lucia v. SEC determines that ALJs do have the constitutional status, and 2018 Presidential Executive Order exempts ALJs from the competitive service and appointment procedure under competitive requirement by the Office of Personnel Management. The controversy regarding the constitutional status of ALJs had been originated from more fundamental legal debate: whether the combination of powers by the federal agencies is legitimate under the separation of powers of the Constitution. Humphrey’s Executor v. United States approves its constitutional legitimacy, and thereafter President Roosevelt progressively introduced the expert administrative tribunal as internal structures in the federal agencies for regulatory professions. The expert administrative tribunal system further developed under the Administrative Procedure Act of 1946, and has made contributions to the regulatory professions, law interpretations and regulatory enforcements. Lucia v. SEC will furthermore contribute to expand the regulatory scope and powers of the SEC and federal agencies. However, some differences in the utilization of adversary system by the ALJs across federal agencies such as between SEC and SSA may require appropriate systemic improvement in order to establish a better harmonized ALJs framework with the Constitution.
