Abstract
This study aims to examine the legal issues related to digital twins, which is being newly promoted in line with the major shift toward a digital society brought about by the Fourth Industrial Revolution, the hyper-connected society, and artificial intelligence. Digital twins is a technology that simulates phenomena that could occur in the real world through virtual models in a digital space to predict outcomes. It offers convenience and efficiency that surpass the era of transhumanism, which seeks to enhance human mental and physical capabilities through scientific technology. However, as digital twin technology advances and its application becomes commercialized, various social and legal issues are being raised. Therefore, the innovative potential of digital twins must ultimately be accommodated and harmonized within the existing legal framework, and the development of digital twin technology requires the relaxation of specific legal regulations and clarification of the existing legal framework. The implementation of digital twins is based on converted data from physical entities, so data, algorithms, and artificial intelligence systems become core components. In this regard, issues such as the integrity and ownership of data and algorithms used in digital twins are important legal issues. Furthermore, with the advent of of digital humans or digital self, there is a need to consider fundamental rights of the digital person within the existing regulatory framework and to expand those rights. Considering the fact that we are entering an era of digitalization and AI transformation, where large amounts of information are distributed and disseminated, and the government's level of information accumulation is improving, leading to greater demands for the protection of individual rights, it is necessary to enhance the legal framework for new fundamental rights of digital person called meta-rights, who exists between humans and objects, such as digital personality rights, digital self-determination rights, the right to be forgotten, and the right to digital deletion. Ultimately, our efforts are required to establish a symbiotic legal system that ensures the development of digital technology harmonizes with human dignity and autonomy.
