미국 민사소송절차에서 당사자의 개인정보 보호

초록

미국에서는 사건의 당사자뿐 아니라 일반 공중도 민사소송기록 전체를 열람하는 것이 원칙적으로 가능하다. 전자소송 시대에 들어서는 법원청사를 방문하지 않고도 누구든 마음만 먹으면 언제 어디서든 인터넷을 통해 손쉽게 타인의 소송기록을 들여다볼 수 있게 되었다. 미국에서는 민사소송기록 공개를 통해 발생할 수 있는 당사자의 개인정보 및 프라이버스 침해 문제에 대하여 다음과 같이 대처하고 있다. 첫째, 민사소송절차에서 법원의 수집하는 당사자의 개인정보의 범위를 최소화한다. 둘째, 법원에 제출하는 서류와 재판절차 속기록에서 민감한 개인정보를 비식별화할 책임과 민감한 서류는 공중의 열람이 제한되도록 할 책임을 당사자에게 지우는 방식으로 문제를 해결하고 있다. 셋째, 신원이 노출되지 않게 보호되어야 할 당사자는 익명으로 민사소송절차를 진행할 수 있도록 하고 있다.

Abstract

In the United States, the court records of a civil case are available to the public, with a few exceptions. The era of electronic filing has granted easy access to court records at anytime and anywhere for the public by means of the Internet, without visiting the courthouse. In the United States, the problem of infringement of the personal information and privacy of the parties, which may arise by the disclosure of these civil court records, has been addressed as follows: First, the courts minimize the scope of the personal information of the parties that they collect during civil proceedings. Secondly, the courts impose on the parties the responsibility for redacting sensitive personal information in the transcripts of the court proceedings as well as in the documents filed by the parties to the court. These parties are also responsible for getting courts’ order to restrict public access to sensitive documents. Finally, the courts allow the parties, whose identity must remain confidential, to proceed with the court proceedings anonymously.
