Abstract
As coastal States can claim their continental shelves beyond 200 nautical miles in accordance with Article 76(1) of the United Nations Convention on the Law of the Sea, the issue of delimitation of the continental shelf beyond 200 nautical miles has, in consequence, emerged. Starting with the 2012 Bay of Bengal case of the ITLOS, a total of four cases regarding the delimitation of the continental shelf beyond 200 nautical miles have been carried out by international courts and tribunals. Prior to 2012, a couple of misunderstandings regarding jurisdiction, entitlement or the distinction between delimitation and delineation had prevented them from addressing the issue of delimitation of the continental shelf beyond 200 nautical miles. Since the 2012 Bay of Bengal case of the ITLOS, international courts and tribunals have made significant progress in delimiting the continental shelf beyond 200 nautical miles. In particular, the 2014 Bangladesh v. India case of the Annex VII Tribunal did not show much difference from the delimitation of the continental shelf within 200 nautical miles to the extent that it is difficult to find a fault in relation to jurisdiction or the application of the three-stage methodology. However, in the 2021 Somalia v. Kenya case of the ICJ, the boundary of the continental shelf within 200 nautical miles was simply extended beyond 200 nautical miles in the same direction, along with the unconvincing logic of the ICJ. Hence, the expression ‘back to pre-2012’ is appropriate, and the matter of delimitation of the continental shelf beyond 200 nautical miles has to be re-examined. While the ICJ reset the problem of delimitation of the continental shelf beyond 200 nautical miles back to the initial stage, the questions should be asked how the three-stage methodology would be applied in the delimitation of the continental shelf beyond 200 nautical miles or why the boundaries of the continental shelf within AND beyond 200 nautical miles should be made in the same direction. In the future, the problem of delimitation of the continental shelf beyond 200 nautical miles is likely to be the most challenging issue in maritime delimitation.
