Abstract
Since the practice of vertical price fixing(resale price maintenance; RPM) is illegal per se under §29 of the Korean Monopoly Regulation and Fair Trade Act, the threshold issue is whether restraint or binding condition exists. As in the case of horizontal restraints, the restraint issue is especially complex because the question often becomes one of how much circumstantial evidence is necessary to permit the restraint. In this article, the author analyses the requirement of resale price maintenance, especially with the emphasis on the restraint requirement. For purpose of this analysis, the author examines the related U.S. decisions after the ꡒColgate Doctrineꡓ as well as the decisions issued by Korean Fair Trade Commission (KFTC), and Court. Upon the above analysis, this article concludes that the general view of Korean and Japanese scholars, Korean and Japanese Fair Trade Commission have interpreted the meaning of restraint in vertical price fixing very widely, in comparison with the U.S. Court. Also, this article suggests that the guidelines regarding the regulation of resale price maintenance in order to secure the transparency of the enforcement of the provision as well as to prevent the abuse of the authority.
