몽골의 운송 관련 법률: 해상 및 수상운송법에 관한 분석을 중심으로

몽골은 최근 다양한 운송 인프라의 확충에 많은 노력을 하면서, 내륙국이라는 한계를 극복하고 러시아와 중국에 의존하는 현재의 경제구조를 개선하려고 한다. 이와 관련된 몽골의 운송법제 역시 다양한 개선이 이루어지고 있으며, 발전가능성도 높다고 평가된다. 한국과 몽골의 물류 협력은 해양국과 내륙국의 호혜적 시각에서 출발하여 몇 차례 좋은 성과를 도출하기도 하였다. 이것은 동북아 경제협력과 분업구조를 고려하여 몽골의 복합운송망 구축과 운영에 다자간 협력에도 시사하는 바가 크다. 몽골은 내륙국이면서도 해운의 중요성과 복합운송 증대를 고려하여 해운관련 정책을 수립하면서 해운분야의 발전을 기대하고 있다. 몽골은 해운 관련 국제조약에 가입한 이후 울란바토르를 편의치적으로 활용할 수 있도록 하는 ‘해법’ (Maritime Law)과, 주로 러시아와 인접한 내륙 수상운송에 적용될 수 있는 ‘수상운송법’(Act on Water transportation) 등을 기반으로 운송수단의 다양화와 규율을 강화하였다. 몽골의 운송수단 다양화 정책이 본격적인 결과를 드러내면, 지금보다 해운산업 수요가 늘 것이다. 이것은 편의치적 활용의 수준을 넘어서, 북극항로로 연결되는 국제하천의 활용 등을 고려한 새로운 단계로의 발전을 의미한다. 따라서 몽골의 해상운송 관련 법제뿐만 아니라, 해상운송으로 이어지는 수상운송의 관심이 필요하다. 향후 몽골과 한국의 해운분야 협력도 보다 확대될 것으로 기대되며, 나아가 몽골의 사례는 높은 운송비용과 낮은 해상운송 이용가능성으로 경제발전에 장애물을 안고 있는 아시아의 내륙국들에도 적용될 수 있다는 점에 주목해야 한다. 한국은 해운 및 수상운송 분야의 법제협력 또는 국제사회에서의 공조를 목표로, 몽골 및 아시아 내륙국과의 국내법적 조화를 마련하는 노력을 강화해야 한다. 몽골의 관련 국내법을 개선하기 위한 작업에, 한국의 법제지원과 협력으로 장기적인 안목에서 양국의 공동이익을 도모할 수 있을 것이다. 침체에 빠진 한국의 해운관련 분야가 새로운 활로를 찾기 위해서도 이러한 노력이 필요하다.
Abstract
Transportation plays a major role in the economic activities. The development of the transport infrastructure is vital for the economic growth of any country. As a landlocked country, Mongolia relies on its neighbours for access to international markets. Although the Mongolian economy is continuing to grow at a furious pace in these days, the transportation network of this landlocked country is underdeveloped. The key new driver of the economy, mining sector, depends greatly on an adequate transport structure. Yet, the realisation that the existing infrastructure is far from adequate for this places a major challenge on transport sector. The sector’s impact on the economy as a whole is significant along with the big mining investment projects presents a unique development opportunity for the Mongolian economy as a whole. The Mongolian government has developed numerous strategies for the transport sector encompassing expected goals for the long term and anticipated budgets. Mongolia is also developing its water transport system. This country already joined several international laws and organisations. Then, it is trying to establish domestic legal and administrative systems harmonising the international rules. Since the 1990s, the government has made the Maritime Act and the Act on Water Transportation. These domestic laws can be legal bases for the development of the industry and economy. However, the legal environment of the marine or water transport has not been fully formed. Therefore, there can be many critical issues of this sector.
