Abstract

Recently, Korean Supreme Court ruling recognizing the eligibility of the unborn child as the insured came out, and the ruling is an important Supreme Court ruling that is a precedent for the unfairness of the unborn child. According to the interpretation of the Commercial Law, the insured person of the accident insurance seems to presuppose the person once. However, it is not easy to answer the question of whether a fetus can be regarded as a person who is an insured person of injury insurance. Unless you take general caution in the protection of the fetus, the interpretation that you have to make special provisions may be more persuasive. However, I do not think it is necessary to be a person in a strict sense when judging the eligibility of an insured person for an injury insurance of a fetus. If the terms clearly define that the fetus is included in the insured, it is consistent with the precedents in which it is observed to be in accordance with that provision, and it can be put in place in accordance with our law. Rather, in the United States, the Born Alive Rule is also moving toward the actively protecting the fetus in various areas, including disposing of the procedure. In insurance reimbursement, it is in the direction of expanding the coverage of insurance insurance if it is rarely found that the personality of the fetus is neglected. Rather, even if there is no explicit rule in the terms, the fetus is regarded as a person and interpreted as an insured person. In order to protect the life and body of the fetus, the insured person's eligibility for the insured person should be broadened to cover the interests of the public as well as individuals, and the insurance policy does not contradict Article 663 of the Commercial Act.
