Abstract

What is conscience? From a moral or legal perspective, what importance does conscience hold? They are important but difficult questions that philosophers and legal scholars of our time can’t just dodge. Further, these questions are not merely questions of scholarly interest only in a country where a strict conscription system is in place, for it will have a life-changing impact on individuals how we answer them. However, it is doubtful whether the academic community in Korea has put an effort on answering the questions as much as it should do in the light of their urgency and gravity. Philosophers commonly rest content to introduce individual philosophers’ views of conscience such as Aquinas, Kant, Hegel, etc. Meanwhile legal scholars have shown only scanty interest on the philosophy of conscience. Research work that examines issues about conscience such as conscientious objection to military services by combining a competent knowledge of the context and history of the Korean judicial system and an extensive understanding of philosophers’ effort to understand the nature of conscience is badly needed. This paper is a response to this need. In this paper, I will first show that conscience commands a certain authority in our mind. Next, I give an overview of what philosophers have said about the authority of conscience. Intellectualism, the relativistic challenge against intellectualism, and volitionalism will be discussed in this order. It will feature Thomas Aquinas, Immanuel Kant,Adam Smith, Sigmund Freud, Bernard Williams, and Michael Sandel. In 2018, the Constitutional Court legalized conscientious objection to military services. In its sentencing letter, it presents the most systematic and detailed account of conscience that has ever been provided by any judiciary organizations of Korea. I will scrutinize and classify it as a version of the volitionalist approach to the authority of conscience. I will close the paper by pointing out that volitionalism has its own share of difficulty.
