어선의 항법상 지위와 항법규정 개선 방안 - 실증적 연구를 중심으로 -

어선은 일반상선에 비하여 다양한 항법상 상황에 놓이게 된다. 횡단상태, 추월상태, 정면상태에서의 항법, 제한시계의 항법, 정박선등의 항법이 적용되는 것은 일반상선과 같다. 일반상선과 달리 어선은 어로작업을 하게 되므로 우선권이 인정될 것인지와 관련하여 복잡한 항법이 적용될 여지를 안고 있다. 어선은 어항에서 머물고 입출항하지만 선박입출항법의 적용대상이 아닌 어항이 많다. 이에 필자는 해양안전심판원과 수협중앙회의 조사보고서를 통하여 어선의 충돌사고를 분석하여 충돌을 예방하고 사고를 저감하는 방안을 제시하고자 한다. 그 결과 첫째, 선원의 상무규정이 너무 많이 적용되어 어선에 적용되는 항법이 불안정하다는 점, 둘째, 무역항이 아닌 어항에 적용되는 항법규정이 없다는 점이 도출되었다. 이에 필자는 항법규정을 더 명확히하는 한편, 해사안전법에 어항에서의 항법규정을 추가할 것을 제안하고 있다.
Abstract
Fishing vessels are involved in the variety of collision situation such as crossing, overtaking, head-on, restricted visibility and vessel at anchor. The above examples are common both in fishing vessels and commercial vessel. The special feature of the fishing vessel in terms of navigation rules exist in the vessel engaged in fishing. The fishing vessel may have privilege over the other general power driven vessel in case that it engages in fishing with fishing net restricting its ability to manoeuvre. If not, the vessel may not have the privilege. The authors tried to examine to classify the collision situation involved in the fishing vessels. The authors collected decisions from Korean Maritime Safety Tribunal and collision reports from Korean National Federation of Fisheries Cooperatives. The authors found that ordinary practice of seamanship rules are applied too much and that there are no special rules for fishing vessels within the fishing harbor area, which invites risk of collision. Therefore, the authors tried to clarify what is the correct rules in several situation involved in fishing vessels and suggest insertion of new rules in the Marine Safety Act for fishing vessel at fishing harbor.
