인도의 내분비계 장애물질 및 화학 물질 규제현황

초록

인도의 내분비계 장애물질을 규제를 위하여 한국법제와 비교를 통한 인도의 통합적 법률 정비에 영향을 주기 위함이다. 이 연구는 플라스틱 제품, 의류, 그리고 어린이 장난감에서 검출된 비스페놀 A, 노닐 페놀, 그리고 프탈레이트 세 가지 물질의 침해 현황 조사, 유해 화학 물질 규제 현황 및 한국 인도간의 환경법 법령 체제에 대해서 간학문적으로 수집된 자료를 통해, 간학문 및 비교법적 연구를 하였다. 법학, 의학 등의 관련 논문, 신문 기사 및 정부 자료를 수집하여 대응 입법 방안을 연구하였다. 결과로서, 노닐 페놀 금지 규정 수립과 비스페놀 A와 프탈레이트의 규제 개혁의 필요성이 도출되었다. 이 연구의 시사점으로는, 인도의 내분비계 장애 물질 규제 입법 수립을 통한 인도 국민의 환경 개선의 증진 도모를, 한국의 입장에서는 법제 협력을 통해 또 다른 대상국에게 법치주의 확산과 개별법의 개혁을 위한 중, 장기적 협력 프로그램의 수립 및 조정에 영향을 미칠 것이며, 통합적 환경 관리에 의한 내분비계 장애 물질에 대한 대응책 수립에도 기여할 것이다.

Abstract

The purpose of this study is to establish the integrated legal reform of India through comparison of the Korean and Indian legal system trough analysis for regulating endocrine disruptors in India. This study apply interdisciplinary method for the study on the usage current status of the three bisphenol A, nonylphenol, and phthalate substances contained in plastic products, clothing, children's toys, and the current status of toxic chemicals regulation, Through the interdisciplinary and comparative studies, Law, medicine, newspaper articles and government data were collected to find countermeasures. As a result, it needs nonylphenol ban provisions and the regulatory reform of bisphenol A and phthalates is necessary. The implications of this study are to promote the improvement of the environmental improvement of the Indian people through legislation on the regulation of endocrine disruptive substances in India and to promote the improvement of the individual law through the legal cooperation, contribute the formulation and coordination of long-term cooperative programs, and will affect to the establishment of countermeasures against endocrine disruptor substances through integrated environmental management.
