한국 장애인 건축물 접근권의 현황과 과제

본 논문은 장애인의 사회활동과 참여에 있어서 가장 중요한 장애인 건축물 접근권의 의미를 살펴보고 한국 장애인 건축물 접근권의 실태와 개선방안을 논의하기 위한 것이다. 장애인의 완전한 사회활동과 참여를 위해서는 접근성이 보장되어야 하기에, 장애인 및 장애인단체는 그동안 장애인의 접근권 보장을 줄기차게 요구하며 저항해 왔다. 이러한 장애인의 요구에 따라 정부는 1981년에 「심신장애자복지법」이 제정되면서 편의시설 정책을 추진해 왔으며, 현재는 「장애인, 노인, 임산부 등의 편의증진보장에 관한 법률」에 따라 국가종합5개년계획을 수립하고 매5년마다 편의시설 전수조사를 실시하고 있다. 편의시설 적정 설치율 현황은 2013년 현재, 60.2%에 이르고 있지만, 장애인들의 체감율은 매우 다르다. 그 이유는 편의시설 설치만으로는 접근성 보장이 되지 않기 때문이며 다른 하나는 실생활에서 이용하는 영화관, 관광지 등의 접근성이 매우 낮기 때문이다. 이를 개선하기 위해서는 편의시설 설치에서 접근성 보장으로 정책 패러다임을 바꾸어야 하며, 관련 법률인 장애인등편의법과 교통약자법의 통합, 합리적 편의제공의 포함, 유니버설 디자인의 적용 등이 필요하다.
Abstract
The purpose of this study is to discuss the meaning of the right to access for buildings environment, which is the most important for the social activities and participation of persons with disabilities, Accessibility has to be ensured for the full social activities and participation of persons with disabilities, so the disabled groups have long resisted and demanded the ensuring of the accessibility for persons with disabilities. In response to the ask of disabled group, the Korean government has promoted the convenience facilities policy in 1981 with the enactment of the Welfare Act for Disabled Persons. In accordance with the Act on the Promotion of the Convenience of Persons with Disabilities, Elderly and Pregnant Women, And conducts a survey on convenience facilities every five years. As of 2013, 60.2% of facilities are suitable, but the rate of people with disabilities is very different. The reason is that accessibility is not ensured only by convenience facilities, and the other is that the accessibility of movie theaters and tourist attractions in real life is very low. In order to improve this, the policy paradigm should be changed from convenience facilities to ensuring accessibility. It is necessary to integrate convenience law such as Act on Guarantee of Promotion of Convenience and Act on Guarantee of Promotion of transportation, including reasonable accommodation and universal design.
