초록
The present paper provides an analysis of the criminal legislation in Sharia-based countries, focusing primarily on member states of the League of Arab States. The constitutions of these countries indicate Sharia as a primary source and sometimes, as a single source of legislation as well of criminal legislation. The institutions of punishment mitigation, including the determination of punishment for hadd, qisas, and taʼazir1 offenses based on mitigating and aggravating factors in sentencing, as well as the mitigation of punishment for minors, women, the elderly, and individuals with diminished responsibility, have been reviewed. By analyzing the aforementioned issues, the study utilizes not only the criminal law norms but also verses from the Noble Quran, narratives from the Sunnah, and the opinions of scholars from the Hanafi, Hanbali, Shafiʼi, and Maliki schools. Upon reviewing these issues related to the mitigation of punishment, it was concluded that Sharia-based and non-Sharia-based criminal laws share numerous analogous institutions.
