Abstract

People's Republic of China has taken great change to adopt a reformative policy in economy, from 1978. This study searched into founding a business company in the corporation law of the People's Republic of China legislated in 1993. Nowadays this law is in progress that makes a partial amendment. First of all, this paper investigated the history of company system in People's Republic of China to carry out accomplishment of this study. And then, it searched into formalities of incorporation of company among the lots of issues, and studied the structure and function of the company. specially, this study has focused on foundation of business corporation among the several types of company in People's Republic of China. Also this research is comparative study, so the paper tried to find out principal legal differences, and tried to look for the similarities and differences corporation system between china and korea. In conclusion, summarized many problems awaiting solution company law of the People's Republic of China hereafter.
