Issues on Intellectual Property Securitization in Taiwan

대만에서 기술이나 디지털 콘텐트 산업의 사업자금을 조달하기 위한 수단으로 지식재산을 증권화하는 방법이 인정되고 있다. 본고는 지식재산권의 증권화에 대한 정의, 특허증권의 자금조달, 자산증권화의 위험에 대한 관리, 증권화 과정에서의 기준과 이익에 있어서 다양한 유형의 증권화에 따른 경제적 기능과 특징을 분석하였다. 여기서 얻어진 지식은 특허증권화의 개발과 각국에서 진행되고 있는 법제화의 비교에도 적용된다. 또한 대만에 있어서 금융자산의 증권화를 모델로 어떤 식의 법제화가 행하여질지도 알아본다. 자산가치의 객관적 평가, 자금모집의 보증, 자금모집 목표의 달성은 증권에 대한 담보로 사용되는 지식재산의 사용하는 동안 자금을 제공하는 기관들에 대한 신뢰수준을 높여준다. 증권화는 특허를 더욱 개발할 수 있는 자금을 조달할 수 있는 새로운 금융기법이다. 필자는 대만의 지식재산 증권화에 대한 이 연구결과가 아시아 각국의 지식재산의 법제화에 기여하기를 기대한다.
