남북경제협력 사업에 관한 미국 대북제재법 상 법적 쟁점 －오토 웜비어법 등을 중심으로－

초록

북한의 비핵화와 관련하여 미국과 북한 간의 의견이 아직까지는 완전히 일치하고 있지는않지만 2018년 미북 간 싱가포르 정상회담 이후로 이들 두 나라의 외교적 관계는 계속해서어느 정도 진전을 보이고 있다. 한 편, 미중 간 무역전쟁, 세계 경기 둔화 및 다른 여러 국내외적인 요인에 의하여 우리나라 또한 다른 여러 나라들과 마찬가지로 경제위기의 위협에대응해야 하는 상황에 처하였는데, 이에 대한 해법으로 제시되는 방법 중 하나가 남북 경제협력이다. 물론 남북 경제협력이 성공적으로 이루어질 수 있다면 이는 현재의 위기를 기회로 바꿀수 있는 최상의 방법일 수도 있다. 그런데 남북 경제협력이 성공적으로 이루어지기 위해서는, 즉 남북 경제협력을 통해 우리나라의 경제위기 상황을 성공적으로 타파하고 경제적 성과를 향유할 수 있기 위해서는 몇 가지 선결조건이 충족이 되어야 한다. 그러한 선결조건중 가장 중요한 조건은 바로 국제사회의 대북제재 정책을 올바로 이해해야 한다는 점이다. 이 논문은 이러한 선결조건을 충족하기 위하여 국제사회, 특히 미국의 대북제재에 초점을 맞추어 다음의 사안에 대하여 파악해 보았다. 즉 미국 대북제재 정책의 기초가 되는 현행 근거법령들은 어떠한 구조로 형성되어 있으며, 각 근거법령의 내용은 무엇이고, 미국 대북제재법령상 남북경협 사업의 성패를 좌우하는 법적 쟁점은 무엇이며, 각 대북제재 정책의 면제, 보류, 정지 및 종료는 어떻게 가능한지에 대하여 알아보았다. 이에 더하여 최근통과된 오토 웜비어 북핵 제재 및 집행법(Otto Warmbier North Korea Nuclear Sanctions and Enforcement Act of 2019, 이하 ‘오토 웜비어법’)의 내용도 살펴보았다. 그리고 결론적으로 이러한 미국의 대북제재 법령에 대한 이해를 기초로 할 때, 남북경협 사업을 성공적으로 추진하기 위하여 우리의 노력이 초점을 맞추어야 하는 부분은 무엇인지에 대하여 고찰해보았다.

Abstract

Although no definitive agreement on the issue of the denuclearization of North Korea has been reached yet, the United States of America and North Korea are making some progress in their diplomatic relationship since the Singapore summit in 2018. Meanwhile, because of various domestic and international factors such as the trade war between the United States and China and the global economic slowdown, South Korea is presently facing a threat of economic crisis. With the hope of improvement of the relationship between the United States and North Korea, inter-Korean economic cooperation is often suggested as a solution to such potential economic crisis. Indeed, economic cooperation between the two Koreas may be a good way to turn the potential economic crisis into a new opportunity. However, in order for the scheme to be successful, that is, in order for the South Koreans to successfully overcome the economic crisis and enjoy economic benefits through inter-Korean economic cooperation, several prerequisites must be met before the implementation of the economic cooperation, the most important one of which is to well understand the international community’s sanctions policy on North Korea. Therefore, this paper focused on the North Korea sanctions law of the international community, especially that of the United States so that we may comprehensively review the contents of current North Korea sanctions laws and regulations and the potential legal issues relevant to the inter-Korean economic cooperation. Especially, this paper focused on the prerequisites to get license, waiver, suspension or termination of transactions which are targets of sanctions and analyzed how likely to get these measures so that we may successfully pursue inter-Korean economic cooperation. In reviewing these issues, this paper examined various Presidential executive orders and U.S. federal laws on the North Korea sanctions including the recently enacted “Otto Warmbier North Korea Nuclear Sanctions and Enforcement Act of 2019”. After reviewing the issues above, this paper suggested some ways to successfully pursue inter-Korean economic cooperation.
