이 연구는 UNCITRAL(유엔국제상거래법위원회) 실무그룹 1의 향후 과제와 관련된 것으로서 사회기반시설에 대한 국제 민간투자에 대한 2001년 및 2003년에 각각 마련된UNCITRAL Legislative Guide to Privately Financed Infrastructure Projects(PFIP Guide)와UNCITRAL Model Legislative Provisions on Privately Financed Infrastructure Project(Model Provisions)을 개정함에 있어서 새로운 법적 쟁점과 방법론을 조사하여 분석하는것을 목적으로 하고 있다. 사회기반시설에 대한 민간투자방식(public private partnerships:PPP)은 민간의 기술과 전문성을 활용하는 동시에 정부재정의 부족분을 대체할 수 있는 방안으로 활용되고 있다. 민간투자 실시계약은 공법상 계약의 성질을 가지므로 계약이전과계약체결 과정 및 이후 단계에서 사적 계약과 다른 특수성이 반영된다. UNCITRAL은2013년 5월에 PPP관련 콜로키움을 개최하고 관련 법적 이슈에 대하여 논의하였다. 이 연구는 사회기반시설에 대한 국제 민간투자와 관련된 법적 쟁점들을 조사⋅분석하여향후 UNCITRAL 논의의 방향을 제시하고 또한 PPP 관련 모델법 제정의 필요성을 강조하였다. 나아가 국내 “사회기반시설에 대한 민간투자법”의 개선에 도움이 될 수 있는 시사점을 도출하고자 하였다.
