한-미 자유무역협정(FTA)의 국내적 이행과 관련된 사례와 법적 쟁점 - 위생검역, 보건, 의약품, 안전 및 환경 관련 규정을 중심으로 -

초록

본 논문은, 위생검역, 보건, 의약품, 안전 및 환경 관련 규정을 중심으로, ‘한-미 자유무역협정(FTA)’의 국내적 이행과 관련된 사례와 실체적인 법적 쟁점을 검토하고, 지역경제통합을 동북아평화번영경제공동체로 발전시키기 위한 정책적 과제들을 제안하였다. FTA의 실효성은 그 규정을 이행함으로써 달성되기 때문에, 무역협정의 이행을 둘러싼 법적 쟁점들을 검토하는 것은 FTA의 실효성을 평가하고, 분쟁을 사전에 방지하고, 지역경제통합을 성공적으로 완성하기 위해 매우 중요하다. 이 글에서 소개된 5가지 사례들은, 인간의 존엄성에 입각한, 인체건강과 생명, 안전 및 환경을 보호하기 위한 우리나라의 공공정책 집행이 미국정부의 외교적 항의 또는 압력 때문에 지연ㆍ취소되거나 상당히 수정되었음을 보여준다. 일반적으로 한국정부는 ‘한-미 FTA’상의 정당한 권리를 적극적으로 행사하기 보다는 미국과 타협하는 경향을 가지고 있는 것으로 평가된다. 국민의 생활수준과 질적 삶을 향상시키고 지속가능한 ‘동북아평화번영공동체’로 발전시키기 위한, ‘한-미 FTA’의 향후 정책적 과제는 다음과 같이 제안할 수 있다. 첫째, ‘한-미 FTA’의 이행과 관련한 협정문은 특정 당사국 및 대기업의 경제적ㆍ상업적 이익을 우선적으로 고려하는 것이 아니라 ‘지속가능한 동북아평화번영공동체’를 구축하기 위한 목표에 부합되도록 해석ㆍ적용되어야 한다. 둘째, 인간의 존엄성은 모든 법규와 제도를 정당화하는 근본규범이기 때문에 자유무역과 투자자유화 가치에 우선되어야 한다. 따라서 인간의 존엄성에 기초한 인간의 생명, 건강 및 안전에 관련된 정당한 공공정책의 가치는 자유무역 및 투자 자유화 가치보다 우선되어야 한다. 셋째, ‘한-미 FTA’를 적극적으로 활용하려는 정부당국의 적극적인 ‘정치적 의지’가 무엇보다 중요하다. 국민건강, 생명, 안전에 관련된 공익적 가치를 적극적으로 보호하고자 하는 정부당국의 정책적 의지가 없다면 ‘한-미 FTA’상의 권리는 종이조각에 불과할 것이다.

Abstract

This article reviewed substantive legal issues resulting from the implementation of provisions related to sanitation and phytosanitation, health protection, pharmaceuticals, safety and the environment under the Korea-US Free Trade Agreement (KOR-US FTA), and made some policy proposals to develop a regional economic integration into the North-East Peace and Prosperity Economic Community. Since the effectiveness of FTA can be accomplished by implementing its provisions, the review of legal issues surrounding the implementation of trade agreements is very important for the parties to evaluate the effectiveness of FTA, to prevent trade disputes in advance, and to complete successfully the regional economic integration. Five cases introduced in this paper show us that the enforcement of public policy of South Korea for protecting human health and life, safety and the environment based on human dignity has been postponed, cancelled or modified a lot because of diplomatic protests or pressure made by the US government. In general, the Korean government has a tendency to make a compromise with the US rather than to exercise positively legitimate rights under the KOR-US FTA. Policy proposals to improve living standards and quality of life and to develop the KOR-US FTA into the North-East Peace and Prosperity Economic Community may be made as follows: First, the KOR-US FTA should be interpreted and applied in a manner to conform to the objectives establishing sustainable regional economic integration, not to consider exclusively economic and commercial interests of a party and big companies. Second, since the principle of human dignity is a basic norm justifying all legalregulations and institutions, it must have priority over the values of free trade andinvestment liberalization. The value of legitimate public policy related to human health, life and safety based on human dignity must, therefore, have a priority over that of freetrade and investment liberalization. Third, the positive political will of the Koreangovernment to make a good use of the KOR-US FTA for the enforcement of legitimatepublic policy is important more than anything else. Rights under the KOR-US FTA maybe merely a paper parcel without political will of the government to protect actively thepublic good related to human health, life and safety.
