영미권 서명필적 감정절차와 실제 사례의 고찰

개인적인 필적의 변화와 환경적 및 물리적인 변화에 따른 필적변화 등을 규명하는 것은 매우어려운 일이다. 영미권에서는 필적감정에 대한 중요성을 근대 이후 인지하였으며 문서감정 지침이나 각종의 저서와 그에 관련한 학술 활동을 유지하고 있다. 그리고 과학적인 사실과 체계적인 감정절차를 통하여 필적 변화와 동일성 여부의 규명에 접근하고 있다. 본 연구는 영미권 사법기관의 문서감정 지침서와 관련 저서 그리고 실제 호주 민사법원에서 요청받은 민사소송의 사례를 통하여 서명 필적감정에대한 절차 및 감정사항, 관련용어 그리고 영미권 법체계상 민사소송의 증거 개시절차를 소개함으로써한국의 법률 시장개방에 대비한 필적감정에 참고사항이 될 것으로 기대한다.
Abstract
It is difficult to investigate the variations by physical and environmental effects and accidental or natural variations of individual signature. From a forensic science point of view, signature identification is a concept that is gaining currency among Anglo-sphere and global situation and also forensic document examiners are carefully studying scientific papers, research and examination procedure to learn more about variations of individual handwriting. The goal of this study is to give the procedures of signature identification, interpretations of signature examinations and adjunctively consideration for examination terms on the procedure manual in the AFP, and practical case study of civil litigations in the Australia court. It is hoped that these study finding would help understanding of discovery procedure in the practical aspect of forensic document examination and reference of forensic document practice in case of opening korean legal services in the coming years.
