Abstract
This study compared policies and practices of the criminal justice intervention in batterer treatment programs in Korea with those in the State of California in the United States. There are several differences between two countries. First, batterers in the U.S. are required to complete programs at least 52-week long, while those in Korea, especially in the pre-trial diversion, are required to complete much shorter ones. Second, the pre-trial diversion has recently been introduced to the small number of jurisdictions and expanded rapidly across Korea, while it was prohibited decades ago in the U.S. Third, batterers in the U.S. can be placed to batterer treatment programs only when they have minor or no criminal history in domestic violence, while batterers in Korea can be sent to the program through the pre-trial diversion when they have a serious criminal history in domestic violence and are thus likely to reoffend the victim. Finally, many of criminal justice systems across jurisdictions in the U.S., including police, prosecutors' office, and court, utilize specialized domestic violence units. It is not unusual that the unit consists of as many as 20 persons dedicated to process domestic violence cases. Such units have begun to be used recently in the limited number of jurisdictions in Korea, with the much smaller number of persons employed compared to the U.S. Based upon the study findings, implications of enhancing criminal justice intervention efficacy were considered.
