이 논문의 목적은 헤겔의 자기의식의 변증법이 수용자의 교화를 위한 철학적 근거가 될 수 있음을 논의하는 데 있다. 자기의식은 주관과 객관, 자아와 타자, 유한과 무한을 변증법으로 종합한 의식이다. 연구의 내용은 다음과 같다. 첫째, 헤겔의 변증법의 특징을 제시하였고, ‘욕구’, ‘생명’, ‘정신’을 자기의식의 특징으로 제시하였다. 둘째, 주인과 노예의 변증법에서는 주인과 노예의 특성 및 양자의 관계가 전도되는 논리를 제시하였다. 마지막으로 노예의식의 자유의 조건인 죽음에 대한 공포, 봉사 그리고 노동을 수용자 교화의 계기로 제시하였다. 연구의 결과는 다음과 같다. 자기의식은 모순과 모순의 지양을 통해서 변화 발전하는 인식 능력이다. 따라서 수용자 처우에 있어 심리치료 위주의 프로그램을 지양하고 사회적 관계를 회복하고 적용하는데 필요한 자기의식의 종합적인 능력을 계발하는 데 초점을 맞추어야 한다. 주인과 노예의 변증법은 범죄의 본질 인식과 사회적 관계의 재인식을 강화함으로써 수용자 교화를 촉진할 수 있다. 마지막으로 노동, 훈육, 자기계발 교육은 자기의식의 자율성과 모순되지 않는다는 점을 제시했다.
Abstract
The purpose of this paper is to discuss that Hegel's dialectic of self-consciousness can be a philosophical basis for the correction of prisoners. Self-consciousness is a consciousness that synthesizes subjectivity and objectivity, self and other, finite and infinity by dialectic. The contents of the study are as follows. First, the characteristics of Hegel's dialectic were presented, and 'desire', 'life', and 'spirit' were presented as characteristics of self- consciousness. Second, in the dialectic of master and slave, the logic of the characteristics of master and slave and the relationship between the two was presented. Finally, the conditions for freedom of slavery, fear of death, service, and labor, were also presented as opportunities for correction of prisoners The results of the study are as follows. Self-consciousness is a epistemological ability to change and develop through contradictions and avoidance of contradictions. Therefore, it is necessary to avoid psychological therapy-oriented programs in the treatment of prisoners and focus on developing the comprehensive ability of self-consciousness necessary to restore and apply social relationships. The dialectic of master and slave can promote correction of prisoners by reinforcing awareness of the nature of crime and re-awareness of social relations. Finally, it was suggested that labor, discipline, and self-development education do not contradict the autonomy of self-consciousness.
