Abstract
This study investigates the forensic and judicial utility of DNA as evidence that were extracted from each knifes involved in seven different cases of violent crime. In a judicial system that emphasizes evidence-based trials, it is essential to eliminate errors and biases and implement error-reduction measures by categorizing potential DNA error types to ensure accurate genetic analysis. In the judicial system, false DNA matches (Type I errors) can lead to wrongful convictions of innocent individuals. False DNA non-matches (Type II errors) can result in the wrongful exclusion of perpetrators, potentially leaving cases unsolved and distorting the factual relationships within the case to become inconsistent with the truth. Type I errors include DNA transfers that are irrelevant to the criminal cases themselves, incidental DNA adherence during routine activities, and cases involving Y-STR matches, while Type II errors are categorized as cases including DNA dilution, degradation, and mixed sample complexities (e.q., blood-to-blood, blood-to-touch, touch-to-touch). An analysis of the legal misjudgment regarding DNA evidence found on the knife in the Amanda Knox case, an actual case that happened overseas, highlights that the most crucial steps in interpreting DNA results are the proper collection and management of evidence, along with sufficient amount of prior understanding of the background information about the case and the crime tools. Recently, with the increased sensitivity of STR kits, it has become increasingly challenging to interpret results from evidence containing trace amounts of mixed DNA. DNA results extracted from tools involved in the crime are limited to only indicating the DNA source, and do not fully inform about the actual cell type or the mode by which the DNA was transferred.
