Abstract
This study discusses the implication of a recent liquor tax reform from international trade law perspective. While there are significant differences between WTO and EU's regulation on non-discrimination principle, their actual applications do not much diverge from each other. Especially, in order to invoke the non-discrimination clause, imports need to be taxed differently so as to protect competitive domestic products. First, differential taxation is determined by factors like tax per liter of product, tax per degree of alcohol, and the tax/price ratio. For specific taxes, tax per degree of alcohol is important and, for ad valorem taxes, tax/price ratio matter. Secondly, since internal taxes can distort consumer tastes, potential competition must be considered. Especially, wind and beer are competitive products in the EU which seeks an economic integration beyond free trade. Thus, as liquors like wine become more popular overtime, there may be a time when wine, beer, Takju and other traditional folk liquors become competitive products. Thirdly, in EU unlike the WTO, internal taxes need to have the protective effect of reducing potential consumption of competitive import to the advantage of competing domestic products. For example, differential taxation can not have a protective effect if difference in price between imports and domestic products is virtually the same before and after taxation. On the other hand, in the WTO, protective application has to be determined from the design, structure and architecture of internal taxes. However, because of the difficulties in applying this abstract concept, sometimes protective applications are found to exist when there are discriminatory taxations, although these criterion are clearly separate issue. Fourthly, because there is no limit on taxation method, even hybrid tax systems are allowed so long as there is no discriminatory taxes to protect domestic products. Finally, EU Member States are free to provide tax reliefs to support small breweries, traditional liquors or domestic agricultural products, if such a preferential system is extended without discrimination to an import that satisfies the same condition as domestic products. But such tax advantages are not allowed for like products in the GATT/WTO system. In case of competitive products, nonetheless, differential taxation can be justified, if it is not applied to afford protection to the domestic products.
