Abstract

Measures to cope with the tax avoidance problem of multinational companies due to the digital economy(digitalization of the economy) have begun to be proposed on two kinds of pillars. So-called Pillar 1 is shaking the basic framework of international taxation called fixed workplace taxation from the front by redistributing certain taxation rights regardless of the existence of physical workplaces in market countries where goods are purchased. So-called Pillar 2 intends to indirectly force multinational companies to introduce the lower limit of the effective corporate tax rate (15%) as a countermeasure against the fact that they have withheld income from tax havens to avoid taxes from capital exporting countries. The OECD released the Pillar 2 Model Act in October 2021 and the Model Note in March 2022, and Korea preemptively revised the International Tax Adjustment Act at the end of 2022, establishing Chapter 5 (so-called the "Global Minimum Tax Act"). This article introduced the inherent interpretation of legal regulations of the Global Minimum Tax and a critical review on it. From a more fundamental point of view, it is not known whether the U.S. position, which initially gave momentum to the global introduction of the global minimum tax, will continue to be carried out, and unlike the grand name of the global minimum tax, not many countries have yet incorporated this type of legislation into their legal system. Therefore, this paper insisted that there are many questions about whether it is desirable to have such preemptive regulations ahead of others. This paper also tried to analyze what can be done to make the current "Global Minimum Tax Act" better as of now as follows. First of all, it will be necessary to make the enforcement ordinance on the "Global Minimum Tax Act" more sophisticated to increase consistency with the existing Korean legal system and reduce the possibility of conflict. It is also necessary to fully consider the possibility of policy conflicts with the foreign income exemption system and set a timeline of implementation sufficiently. Furthermore, it might be much wiser not to apply this new "Global Minimum Tax Act" to Korean legal system for a while, from the viewpoint of so-called wait and see policy.
