범죄행동의 조기예측기법에 관한 연구 -사이코패시를 중심으로-

사이코패시의 측정은 모든 형사사법기관에서 공통적인 관심사이다. 사이코패시는 폭력범죄자와 누범의 비율에서 여타 범죄자에 비해서 많은 비율을 차지하고 있으며, 치료적 개입도 쉽지않은 것이 사실이다. 사이코패시 측정의 신뢰도와 타당도는 소년법정에서부터 성진형사사법기관에서도 많은 관심을 가지고 있기도 하다. 사이코패시적 특성에 대한 측정은 소년원이나 교정기관에서 위험성측정과 사정과 분류에 유용하게 이용될 수 있다. 이러한 성공이유는 일반적으로 강력범죄자의 대다수가 아동기내지 소년기에 사이코패시적 특징을 보였다는데 그 이유를 찾을 수 있다. 사이코패시라는 성격특성은 심리학적으로나 생의학의 오랜 역사와 같이 한다고 해도 과언이 아니다. 사이코패시에 관한 최근의 연구성과들은 범죄자의 유형에 대한 판별이나 치료적 개입의 가능성을 줄수 있다는 점에서 그 시사점이 크다 할 것이다. 범죄자의 위험성을 예측한다는 것은 쉬운 연구주제가 아니라 할 수 있으나, 최근의 사이코패시에 대한 연구성과들은 범죄자의 조기예측에 많은 시사점을 주고 있을 뿐만 아니라 강력범죄자의 분류와 예측, 교정에 활용가치가 충분히 있다고 할 수 있다. 따라서 이 논문은 헤어(Hare)박사의 사이코패시 측정도구인 PCL-R의 범죄예측력을 중심으로 검토하였다. 이 논문은 문헌연구적 성격을 가지고 있으므로 논문의 일반화에 한계가 있으며 추후연구에서 조기예측에 대한 실증적인 연구가 필요하다고 생각한다.
Abstract
Recent decades have been marked by tremendous breakthroughs in clinicians' ability to diagnose psychopathy. Assessments of psychopathy have become commonplace in the criminal justice system, as psychopaths, while rare, are significantly more prone to violent crime and recidivism than nonpsychopathic offenders, and disorder is widely understood to be highly resistant, if not immune, to treatment. As the validity and reliability of psychopathy appears well positioned to identify the ideal candidates for waiver from the juvenile court to the adult criminal system -the small subclass of youthful offenders who will not desist in serious lawbreaking as they mature into adulthood. Assessment of psychopathic traits has proven to be useful for screening, classification, and risk assessment in the juvenile or adult correctional system. This success indicates that a small subset of offenders commits a majority of general and serious crimes and has led to a recent and growing interest in children and adolescents who might possess psychopathic traits. Psychopathy refers to a specific, yet controversial, personality construct with a long history in the psychological and biomedical sciences. The current findings also raise some important implications for identification and treatment of subtypes of criminal offenders. The extent to which it is possible to attenuate risks assessed as high on such measures remains unknown. The limitation of this study have general problems for second materials and literature search.
